Creative Minds Terms & Conditions
1. General information
CM is organised by the Jersey College for Girls Foundation (“The Foundation”, “we”, “us”, or “our”) and aims to provide a high-quality consistent and reliable service where every child is safe and happy in a club where the environment is supportive, encouraging, nurturing and where they can relax and have fun.
CM is open to children island wide in years 1 to 6.
The Foundation will promote appropriate standards of behaviour, dicipline and hygiene. You must adhere to all rules, policies, and procedures outlined in this document and communicated during CM and by enrolling you agree to abide by these terms.
2. Code of Conduct
You must:
- Sign your children in with a Creative Minds’ member of staff in JCG reception and sign them out in the same manner at the end of the day
- Late collection will result in a fee of £10 for each quarter of an hour or part thereof, during which your child remains in our care after CM finishes
- Notify us as soon as reasonably practicable if your child is not going to attend•Not bring a child to CM if it is unwell
- Inform the Foundation immediately in writing of any change in contact details or family situations, Court Orders or situations of risk in relation to the child for which any special precautions may be needed
- Treat other children, staff and property with respect, and following instructions given by us
- Refrain from engaging in bullying, harassment, or inappropriate or rude behaviour to other children and staff
- Instil the importance of good behaviour during CM
- Accept that the Foundation is not to be held responsible for any damage or loss to clothing or other personal belongings brought to CM
Any breach of the Code of Conduct may result in:
- Warnings issued to you and/or your child
- Where we decide that your child’s continued presence is incompatible with the interests of CM, you will be immediately removed from the programme without a refund, at our sole discretion and subject to the terms of Clause 4.
3. Payment of fees
All fees must be paid in full prior to the start date of CM and according to those provisions in Clause 4.
- Partial payments or instalment arrangements are only permitted with prior approval, and at our discretion.
- Fees include course fees, snacks and lunch•In relation to international students any flights, insurance both medical and otherwise, and any other additional requirements must be borne by you
- No refund will be given for sessions only partially attended or if a child leaves before or arrives after food is provided
- No refund will be given in the event of absence or sickness
4. Cancellation and Refund Policy
If you cancel your booking, the following refund policy applies:
- Cancellation up to 30 days before the start date:
- 90% refund•Cancellation more than 15 days before the start date: 50% refund
- Cancellation less than 15 days before the start date: No refund
No refund will be provided if your child is removed from CM due to a breach of the Code of Conduct or failure to comply with these Terms and Conditions.You are liable for the full cost incurred and for making the necessary travel arrangements where you have breached the Code of Conduct and have had to be immediately removed.
Persistent lateness will result in the place being withdrawn.
5. Visa and Travel Responsibilities (International Children)
Parents of international children are responsible for obtaining the necessary visa and travel documentation to attend CM and fees do not include visa application costs or related expenses.
If an international child/parent’s visa application is unsuccessful, refunds will be provided according to the terms of clause 4 only. We recommend securing travel insurance to cover such situations.
We are not liable for delays, cancellations, or changes to travel arrangements, and no refund will be provided if any of these scenarios occur.
6. Health and Safety
You authorise the Foundation to take all necessary action to safeguard and promote your child’s welfare and consent to use of such physical contact as may be lawful, appropriate and proper to provide comfort to a child in distress or to maintain safety and good order.
You must disclose any medical conditions, allergies, or special requirements during the registration process or subsequently if they arise after the registration process by email to [email protected]
You must inform us if you have been in contact with any infectious diseases, and must comply with exclusion guidelines set by Health and Social Services with details available on https://www.gov.je/Health/Pages/default.aspx wellbeing
You must carry any necessary medications and provide clear instructions for their use.
You must not attend CM if you are unwell and must inform us as soon as possible of any such absence, for which no refund will be given.
In case of a medical emergency, we will make reasonable efforts to contact parents/guardians immediately using the contact numbers provided. If we cannot establish contact, we have permission to seek necessary medical attention for the participant, including emergency medical treatment, surgery, and/or general anaesthetic if certified as necessary by a doctor.
We have a zero-tolerance policy for behaviour that jeopardizes the safety of others.
All accidents notified to us will be documented in an accident book and reported to parents/guardian.
You agree to inform the Foundation of any information necessary to safeguard or promote your child’s welfare or avert the risk of harm to their child or other person, including learning/physical difficulties and programme staff will be informed of sensitive issues concerning the child on a “need-to-know" basis.
The Foundation welcomes staff and children from different ethnic backgrounds and similarities and differences are valued and respected and all children are treated equally. The Foundation will comply with the Special Educational Needs and the Jersey Disability Law and will do all that is reasonable to accommodate the needs of children with disabilities.
7. Liability
We will take reasonable precautions to ensure your safety and wellbeing, but cannot be held liable for accidents, injuries, damage to or loss of personal property unless caused by gross negligence on our part.
You are encouraged to avoid bringing valuable items to CM. We are not responsible for lost or stolen items.
We undertake to maintain insurances prescribed by law.The CM staff have a duty to report any significant concerns they might have about the safety or wellbeing of a child to Social Services.
8.Use of Images and Media
By enrolling in CM and ticking the relevant box at registration, you consent to the use of photographs or videos of participants for promotional and educational purposes as set out in the application form.
If you do not wish for your child’s image to be used, please tick the relevant box in the application form.
9.Data Protection Clause
We respect your privacy and protect your personal data in accordance with applicable laws. Any information collected is used only for providing andimproving our services. We do not sell or share your data with third parties, except as required by law or to trusted partners who help operate our services under strict confidentiality. We implement security measures to safeguard your data and retain it only as long as necessary. You have the right to access, updated, or delete your personal information.

10.Force Majeure
We shall not be held responsible for cancellations or disruptions caused by events beyond our control, including but not limited to: natural disasters, pandemics, snow or government restrictions. In such cases, refunds or rescheduling will be considered on a case-by-case basis.
In the event of closure due to severe weather, you will be contacted by us.
11.Amendment of Terms and Conditions
We reserve the right to amend these Terms and Conditions at any time. You will be notified of significant changes, and continued participation in CM constitutes acceptance of the revised terms.
12.Acknowledgement and Agreement
By enrolling in CM, you confirm that you have read, understood and agreed to these Terms and Conditions.Failure to comply with these Terms and Conditions may result in dismissal from CM
13.Law
This agreement is governed by the laws of Jersey. Any disputes shall be resolved in the courts of Jersey.
